  • For Client-Controlled Data (e.g., your customer lists, sales data, and other information within your Amazon Seller Central account), WEBPRIME acts as the Data Processor (or “Service Provider” under some laws). We only process this data on your behalf and according to your documented instructions, which are outlined in our Terms of Service and any applicable Statement of Work (SOW). Our Client is the Data Controller for this information.

 

2. Information We Collect

 

We collect information in the following ways:

A. Information You Provide to Us (Client Business Information)

When you inquire about or engage our Services, we collect information about you and your business, including:

  • Contact Information: Your name, company name, job title, email address, and phone number.

  • Billing Information: Billing address and payment details, which are processed by our secure third-party payment processors.

  • Communications: Any information you provide when you contact us for support, send us an email, or communicate with us in any way.

B. Information We Process on Your Behalf (Client-Controlled Data)

To perform the Services as outlined in your SOW, you must grant us access to your third-party accounts, including but not limited to your Amazon Seller Central or Vendor Central account. The data we access and process on your behalf may include:

  • Account Information: Your account credentials and settings.

  • Sales and Performance Data: Sales reports, inventory levels, advertising performance, and other data analytics.

  • Product Information: Product listings, brand assets, and intellectual property.

  • Customer Personal Information: Information related to your customers, such as order details, customer names, shipping addresses, and customer communications. We access this data solely to perform the Services (e.g., manage orders, analyze sales trends, or run advertising campaigns).

C. Information We Collect Automatically (Website Visitor Information)

When you visit our Site, we may automatically collect certain technical information from your device, including:

  • Log Data: Your IP address, browser type, operating system, and pages viewed.

  • To act on your specific, documented instructions.

  • To generate anonymized and aggregated statistical data to improve our internal processes and services (this data will not be traceable to you or your customers).

We will never use your specific Client-Controlled Data (such as your customer lists or sales data) for our own marketing purposes, to sell to a third party, or for any purpose other than providing the Services to you.

C. Use of Website Visitor Information

We use this information to:

  • Analyze and understand how our Site is used.

  • Improve the functionality, security, and performance of our Site.

  • Market our Services.

 

4. How We Share Your Information

  • Amazon Data Protection Policy: We comply with all applicable third-party platform policies, including the Amazon Data Protection Policy. This includes prohibitions on storing PII on removable media and requirements for network protection.

  • Incident Response: We maintain an incident response plan to address any potential security breaches.

You acknowledge that you are also responsible for securing your own account credentials, such as your Amazon Seller Central login, and for complying with all Amazon terms and policies.

 

6. Data Retention

 

We retain data for no longer than is necessary for the purposes for which it is processed.

  • Client Business Information: We retain your information for as long as we have an active business relationship with you and for a reasonable period thereafter to comply with our legal, accounting, and tax obligations.

  • Client-Controlled Data: We retain access to your Client-Controlled Data only for the duration of our engagement as defined in the SOW. Upon termination of our Agreement, we will securely delete or return all Client-Controlled Data in our possession, as described in our Terms of Service.

  • Amazon PII: In accordance with Amazon’s policies, any Personally Identifiable Information (PII) from your Amazon account that we process is retained for no longer than 30 days after order fulfillment.

 

7. Your Privacy Rights

 

A. If You Are a WEBPRIME Client

You have certain rights regarding the Client Business Information we hold about you. You may request to:

  • Access, correct, or update your information.

  • Delete your information (subject to our legal and contractual retention obligations).

  • Opt out of marketing communications by clicking the “unsubscribe” link in any marketing email.

B. If You Are a Customer of a WEBPRIME Client

WEBPRIME acts as a Data Processor for your information. We do not own or control your personal data.

If you are a customer of one of our Clients (e.g., you purchased a product on Amazon from a brand we manage) and wish to exercise your privacy rights (such as the right to access, correct, delete, or opt out of the “sale” of your data under laws like the NJDPA or CCPA), you must contact the brand (our Client) directly. Our Client is the Data Controller and is responsible for responding to your request. We will assist our Clients in responding to such requests as required by law and our contractual agreements.

 

8. Children’s Privacy

 

Our Services and Site are not directed to individuals under the age of 16. We do not knowingly collect personal information from children. If we become aware that we have inadvertently collected such information, we will take steps to delete it.

 

9. Changes to This Privacy Policy
